Raj Khanna from Diamond Harbour || December 23rd 2011 - Under some obnoxious connections of Diamond Harbour local administration and the Islamist groups active in the locality, a hectic process of reconstruction of a bigger Mosque than before is going on in the very protection of the concerned Govt. authorities violating many civic laws and the direction of the Hon'ble Supreme Court of India.

As per available reports, a RTI activist and local leader of Hindu Samhati, a prominent Hindu Organization in some parts of West Bengal put an application before Sub-divisional Officer (SDO), Diamond Harbour to look into the matter for its right and justified disposal of the same.

As per Order of the Hon'ble Supreme Court of India, all the religious structures/shrines are to removed in a time frame for some reasons as held by the bench of  Justice Dalveer Bhandari and Justice Mukundakam Sharma on 31st July 2009.

But, violating all the norms and the Order of the Supreme Court of India, the SDO Diamond Harbour has given the permission and helping the same to reconstruct a bigger Mosque in the premises of Diamond Harbour Criminal Court, with the help of some Muslim Group headed by one Raich Molla of Mandirbazar, South 24 Parganas. Sources said that this Raich Molla has an immense influence over the Diamond Harbour SDO and controls all the tenders etc. to see the interest of local Muslim businessmen and the unauthorized money market. Moreover, this Raich Molla has illegally occupied a portion of a land owned by a Hindu Religious Trust namely "GOPAL JUE TRUST" at Tirtha Kuthir, Hazi Building Para, Diamond Harbour.

This reporter has been able to capture the video footage before and after the demolition (for reconstruction purpose) of the impugned Mosque structure, from where it is evident that a bigger Mosque is going to be erected there with the help some mysterious Islamic funding to reconstruct the same very unlawfully. It has been alleged that a fund of  Rs. 10 lac has been given as bribe to manage the permission of the illegal construction of the mosque and the mosque will be reconstructed with another Rs 5 lac from that mystery source. As a matter of fact the Islamic Groups involved with illegal money market are funding huge amount to construct or reconstruct or to renovate the Mosque all over South 24 Parganas (all over West Bengal also).

The RTI and Hindu activist, Sri Haran Chandra Mondal wanted to know from the authority that :

"(a)        The actual size and type of existing Mosque in question and the proposed reconstructed size and type after reconstruction/renovation of the same.                          

 (b)        The name of the person and the authority who/that passed the related reconstruction/renovation plan of the Mosque in question.
 (c)         The cost of estimated budget for the reconstruction/renovation plan of the Mosque in question and the source to meet the cost.
 (d)        Whether the Sub Divisional Officer, Diamond Harbour has given any permission for the reconstruction/renovation work for the Mosque in written or verbally.
 (e)        Under whose order the Police contingents are guarding the illegal reconstruction/renovation work for the Mosque in question. (Photo enclosed)." 

As per Right to Information Act, 2005, the concerned authority is bound to give the available information within one month after submission of the application with due charges for the same.

It has been gathered that the President and Secretary of the Bar Association of Diamond Harbour Criminal Court, Mohammad Nurul Amin, Advocate and Sri Sudipta Chakroborty, Advocate, respectively are morally helping the Islamic group to erect a bigger Mosque under the Islamic dictum of Trinmool Congress party as they both holds position in the party to see the minority interest even at the cost of violation of rule of the land and the verdit of Hon'ble Supreme court of India.

A sitting Supreme Court judge today supported the inclusion of the Prime Minister's Office within the ambit of Lokpal Bill tabled in Parliament yesterday.

"As a student of law, I see no substance in the debate that the Prime Minister should be outside the (Lokpal) Bill. A public office of such importance cannot shy away from public scrutiny," Justice AK Ganguly said.

The judge was addressing a gathering here on the occasion of the release of a book 'Corruption and Human Rights in India', authored by Professor C Raj Kumar, the Vice Chancellor of OP Jindal Global University.

Pointing out that Prime Minister Manmohan Singh had himself expressed his willingness to bring the PMO under the Lokpal's scanner, Justice Ganguly said "more efforts to keep the PM out will add to the suspicion among people."

In his address, Justice Ganguly also criticised the Prevention of Corruption Act, which stipulates sanction by competent authorities before prosecuting any government servant, bureaucrat or politician on charges of corruption.

"The Prevention of Corruption Act, to my mind, is preservation of corruption act. It has a mechanism to protect the corrupt. Without the sanction, the corrupt cannot be prosecuted. Who is to give you the sanction? They (corrupt) do not act individually and they work in a organised way," he said.

Justice Ganguly is also the part of a two-judge bench which had heard a petition by Janata Party chief Subramanian Swamy seeking guidelines for the grant of sanctions to prosecute those occupying public offices on the charge of corruption and has reserved its order on the plea.

Lokpal Bill introduced in parliament, opposition protests

By IANS, Thursday, 04 August 2011 / New Delhi : The Lokpal Bill which seeks to combat corruption was introduced in parliament amid strong protests from the opposition.
Minister of State in the Prime Minister's Office V. Narayanasamy introduced the bill in the Lok Sabha, the lower house of parliament.

Leader of Opposition in the Lok Sabha Sushma Swaraj of the Bharatiya Janata Party (BJP) strongly opposed the introduction of the bill, demanding that the prime minister should be brought within its ambit. 

The proposed legislation's purview does not bring under it the prime minister during his or her term in office. But once the prime minister demits office, he or she can be investigated for any wrongdoing during the term, according to the bill's provisions.

It also excludes from the Lokpal's ambit the judiciary and any action of an MP in parliament or any parliamentary committee.

"I cannot understand how anyone, sitting in any position, be a holy cow? In this Lokpal why is the prime minister out of it?" Swaraj asked in the house.

"I am happy that the prime minister himself had said that it is okay if he is brought within the ambit of the Lokpal Bill. Then, why is the cabinet not paying heed to it?" she added.

Narayansamy defended the introduction of the bill, saying it has become the property of the house and it will immediately go to the parliamentary standing committee. "Parliament is supreme so the opposition by Swaraj cannot be sustained."

Replying to Swaraj's statement that former prime minister A.B. Vajpayee had accepted to be within the ambit of anti-corruption law, Finance Minister Pranab Mukherjee said: "I was chairing the parliamentary standing committee on anti-corruption bill in 2001."

"I placed it before parliament for two consecutive years. Why wasn't it cleared then?" he asked.

To mark their protest, the civil society representatives led by social activist Anna Hazare burnt copies of the government's version of the bill at several places in the country and asked the nation to do the same.

Madras High Court rejects Chidambaram plea against case challenging his 2009 election


Chennai || 4th August 2011 || Agencies || Indian Express : In a setback for Home Minister P Chidambaram, the Madras High Court on Thursday dismissed his plea against a petition that had challenged his election to the Lok Sabha in 2009.
The petition, challenging his election, was filed by AIADMK's R S Raja Kannappan who had lost to him from the Sivaganga constituency by just 3,354 votes.
In his application, Chidambaram had contended there were some defects in the petition filed by Kannappan.
Chidambaram had claimed the High Court registry had noted the defects when the petition was filed by Kannappan.
Dismissing Chidambaram's application, Justice K Venkatraman said, “There cannot be any doubt that an election petition filed with defects – which cannot be curable – cannot be considered as an election petition at the end. However, in the case in hand, the defects pointed out by the officer concerned are not defects which are not curable warranting dismissal of the election petition.”

he judge said he was of the considered view that the application preferred by Chidambaram “is liable to be rejected and accordingly rejected”.
Kannappan in his petition filed on June 25, 2009 alleged that Chidambaram's election 'deserved' to be declared void due to 'manipulation' of votes and 'corrupt practices' committed by him, his election agents and others, with his consent.
He had also sought recounting of votes polled in the entire constituency, particularly in the Alangudi Assembly segment.
Tamil Nadu Chief Minister Jayalalithaa during her visit to New Delhi in June last had sought the resignation of Chidambaram alleging that he got himself elected to the Parliament by 'fraudulent' means.
She had alleged Chidambaram was announced the successful candidate because of a fraud committed by a data entry operator, but the Union Minister hit back saying her remarks were 'gross contempt of court'.

New Delhi: Former telecom minister A. Raja on Monday sought to drag Prime Minister Manmohan Singh into the 2G spectrum case, prompting the opposition Bharatiya Janata Party (BJP) to seek his and Home Minister P Chidambaram's resignation and the Congress joining the war of words.

Appearing before the special court of the Central Bureau of Investigation (CBI) presided over by Judge OP Saini, Raja's lawyer said 2G spectrum transactions were approved by then finance minister P Chidambaram in the presence of the prime minister.

"Telenor buying a stake in Unitech Wireless and Etisalat buying a stake in DB Realty -- the finance minister approved it in the presence of the prime minister," Raja's counsel Sushil Kumar told the court. 

"Let the PM deny it," the counsel told the judge, referring to the particular time in 2007-08 when Chidambaram was finance minister. "If policies pursued by me were wrong, then all former telecom ministers since 1993 should also be in jail with me," he added.

"As telecom minster Arun Shourie distributed 26 licences, Dayanidhi Maran distributed 25 and I distributed 122. Numbers make no difference. It is to be noted that that none of them auctioned the spectrum. If they had done no wrong, why am I being questioned?"

The government draft on Lokpal Bill, which is expected to be considered by the Cabinet this week, does not include the Prime Minister in the purview of the Ombudsman but the final call on the ticklish issue will be taken by Parliament and its Standing Committee.

Disclosing this, Home Minister P. Chidambaram said the Bill will be introduced in Parliament in the Monsoon session starting on August 1.
The government’s draft has been prepared by the Department of Personnel and Training (DoPT), which is the nodal ministry, and the issue is likely come up before Cabinet this week or early next week.
“Once the Cabinet approves the draft with or without changes — it is the government’s draft that will be introduced in Parliament. So we will introduce the Lokpal Bill in the Monsoon session of Parliament,” he told PTI here.
On the controversial question of bringing the Prime Minister’s post in the ambit of Lokpal, Mr. Chidambaram said, “According to present thinking, and subject to change by the Cabinet, the government’s draft keeps out the Prime Minister.
“...Our considered view at the moment, subject to change by the Cabinet, is that the PM should be kept out of Lokpal,” he added.
The Home Minister noted that there are several arguments for and against keeping the Prime Minister out of the ambit of the anti-corruption watchdog.

The Central Bureau of Investigation (CBI) today arrested Punjab Police DSP Raka Gira while she was accepting a bribe of Rs 1 lakh at her Sector 15 residence here. The CBI also recovered Rs 1 crore cash, jewellery and some property-related documents from her residence.

This is the second case within a fortnight when the CBI has arrested a senior Punjab Police officer in a corruption case. On July 12, the CBI had arrested Punjab AIG PS Sandhu while taking a bribe of Rs 50,000.

The CBI officials said they acted on a complaint by a Mohali-based builder Krishan Malhotra. He has cases registered against him by the Punjab Police and Raka Gira was probing two of the cases. The CBI sources said the deal was initially struck for Rs 2 lakh for conducting inquiries in Malhotra’s favour. She was arrested while accepting the first instalment of Rs 1 lakh.

Gira was recently transferred from the post of DSP (city-I), Mohali, and at present she was attached with a recruitment rally in Ropar district. She had joined the Punjab Police in 1999 as an Inspector after the death of her husband Ranbir Singh, who was also serving the Punjab Police, on compassionate grounds. She will be produced in a CBI court of Ritu Tagore tomorrow.
